How Ontario’s 2025 Personal Injury Law Reforms Could Affect Your Claim

If you’ve been hurt in a car crash, slipped on icy steps, or were injured because someone was careless, the laws in Ontario have changed. These changes could affect your personal injury claim. In 2025, new rules were introduced that mostly help insurance companies. That’s why it’s more important than ever to understand your rights and get the right help.

Bigger Deductibles, Tougher Rules

The government has raised the amount of money that gets taken off your settlement before you see a payout. Here’s what’s new:

  • If you’re claiming pain and suffering, $46,790.05 will now be deducted from your compensation.
  • You only avoid that deduction if your injury is worth more than $155,965.54—a number many injuries don’t reach.
  • If you’re making a Family Law Act claim (like if a loved one was hurt), $23,395.04 will be deducted unless the amount is over $77,982.13.

These changes make it harder to get full compensation.

New Rule for Slip and Fall Claims

If you slip and fall because of snow or ice on private property, you now have just 60 days to report it to the person responsible. There are a few exceptions—like if someone dies or if you have a good reason for waiting—but the clock starts ticking right away.

New Way of Handling Legal Costs

Ontario has also changed how legal fees are handled:

  • 15% of the first $200,000 in damages goes to legal costs
  • 10% of any amount over that

This new rule is meant to make things clearer and fairer when it comes to who pays what.

Mental and Emotional Injuries Matter Too

The courts now understand that not all injuries are physical. If you suffer from things like anxiety, PTSD, or emotional trauma after an accident, you may be able to get compensation for that, too.

Be Careful of Early Settlement Offers

Insurance companies are trying to settle cases quickly, sometimes even before you fully understand your injuries. These early offers can seem tempting, but they’re often much lower than what you deserve. A lawyer can help make sure any offer reflects the real impact of your injuries.

What to Do After an Accident

Insurance companies are trying to settle cases quickly, sometimes even before you fully understand your injuries. These early offers can seem tempting, but they’re often much lower than what you deserve. A lawyer can help make sure any offer reflects the real impact of your injuries.

What to Do After an Accident

1. Get Medical Help Right Away
Even if you feel okay, some injuries take time to show. Seeing a doctor helps your recovery and supports your case.

2. Don’t Rush to Settle
If the insurance company calls with a quick offer, don’t say yes until a lawyer reviews it.

3. Save All the Evidence
Take photos of the scene, your injuries, and any damage. Keep police and medical reports, and even your shoes if you slipped.

4. Talk to a Lawyer Early
The sooner you get legal advice, the better your chance of protecting your rights and getting the compensation you deserve.
